Birth Injury

Birth injury typically occurs during the course of a difficult delivery. Most common injuries during birth are forceps marks and bruises, but some birth injuries are much more severe, including facial paralysis, Cerebral Palsy, Erb's Palsy, or additional brain damage. Many injuries during the birthing process are due to medical malpractice, or negligence at the hands of a medical professional.

It is estimated that more than five out of 1,000 babies are injured annually during the birth process. A doctor or medical professional can be viewed as having acted in a negligent fashion when he or she fails to use the degree of skill and learning ordinarily used under the same or similar circumstances by members of their profession.

Failure of the doctor or other medical professional to respond appropriately in any of the following circumstances may be viewed as negligent:

  • Bleeding by either mother or child
  • Lack of oxygen to either mother or baby
  • Umbilical cord complications
  • Emergency cesarean section
  • Vacuum extractor or use of forceps
